Terms and Conditions for Using Ekshop

Welcome to Ekshop. These Terms and Conditions govern the relationship between you (the "Seller", "Vendor", or "Business") and Ekshop ("we", "our", or "us"). By using our platform, you agree to abide by the conditions outlined in this document. This agreement outlines your responsibilities as a Seller and our role in facilitating transactions between you and the end customer. The content of this document is meant to clarify the nature of your relationship with us and guide your usage of our platform to ensure mutual benefits.

1. Platform Usage

Ekshop is an online platform designed to facilitate the sale of products between businesses (Sellers) and end customers. As a Seller, you will have access to a dedicated dashboard where you can manage product listings, review orders, and track sales data. The platform is designed to make the listing process efficient, allowing you to reach a broad customer base and process sales seamlessly. However, your use of the platform must comply with our policies, and any misuse may result in account suspension or termination.

As a Seller, you bear full responsibility for ensuring that the products listed on Ekshop meet all applicable legal and regulatory requirements. This includes maintaining the accuracy of product descriptions, prices, availability, and other related information. You are expected to ensure that all products are properly categorized and represented with accurate images and descriptions, which will help avoid misleading potential buyers.

Furthermore, we reserve the right to remove listings that violate our policies, contain prohibited content, or fail to comply with relevant laws. All products listed on our platform should be authorized for sale under applicable laws in the jurisdictions in which they are sold. Any attempt to list counterfeit goods or engage in fraudulent activities will lead to immediate termination of your account, and potentially legal action.

2. Commission Structure

At Ekshop, we believe in putting sellers first. That’s why, as of now, we do not charge any commission or fees on items sold through our platform. Every shilling you earn from your sales goes directly to you—helping your business grow without extra costs. This seller-first approach is at the heart of our mission to empower local businesses in Nyeri and beyond. By removing financial barriers, we make it easier for shops to reach more customers, build trust, and expand into future brands. As Ekshop continues to grow, we plan to introduce affordable paid packages designed to add even more value for our sellers. These packages will come with exclusive benefits such as: Increased product visibility Access to advanced sales analytics Promotional opportunities to reach wider audiences Our commitment is clear: your growth is our growth. Today, you enjoy zero commissions. Tomorrow, we’ll provide optional, value-driven tools to help your business thrive even further.

3. Responsibilities of the Seller

As a Seller on Ekshop, you have several responsibilities to ensure the success of your online store and to maintain a positive reputation on the platform. First and foremost, you are responsible for maintaining accurate and up-to-date listings. This includes ensuring that product descriptions, prices, stock levels, and availability are current. Failure to update listings in a timely manner could lead to negative customer experiences and impact your sales performance.

Additionally, you are responsible for ensuring that your products meet the quality standards expected by customers. Any product defects, misrepresentations, or issues related to authenticity will fall under your responsibility, and you must work promptly to resolve any customer complaints or disputes. It is also essential that you comply with all applicable laws, regulations, and policies, including but not limited to intellectual property rights, product safety, and consumer protection laws.

As part of our platform's commitment to customer satisfaction, we expect you to handle returns, exchanges, and refunds in accordance with our guidelines. You are responsible for providing clear return policies and ensuring that any issues raised by customers are addressed within a reasonable timeframe. We encourage transparency and open communication with your customers to ensure long-term success on our platform.

4. Liability

Ekshop is a facilitator of an online market place of Sellers and Buyers . We do not take ownership of the products listed on the platform, nor do we guarantee the quality, safety, or legality of the items sold. As a Seller, you acknowledge that you are solely responsible for the products you list, and any disputes or legal issues arising from the sale of these products will be your responsibility.

We provide the platform "as is" and do not make any warranties or guarantees about the platform's functionality or the results that may be obtained from using it. While we strive to ensure a smooth and seamless user experience, we cannot guarantee that the platform will be available error-free, or free from interruptions. You agree to indemnify and hold Ekshop harmless from any claims, damages, or liabilities arising from your use of the platform or the sale of your products.

In no event shall Ekshop be liable for any indirect, incidental, or consequential damages arising from the use of the platform or the sale of products through the platform. Our total liability to you, whether in contract or tort, will not exceed the amount of commission earned by us from the sale of your products.

5. Termination

Ekshop reserves the right to terminate or suspend your account at any time for violations of these Terms and Conditions, including but not limited to fraudulent activity, misrepresentation, or failure to comply with our platform's policies. We also reserve the right to terminate or suspend your account if your activities jeopardize the security, integrity, or reputation of the platform or its users.

Upon termination of your account, you will no longer have access to your Seller dashboard or be able to list products on the platform. All pending transactions and commissions will be settled according to our usual payment schedule, and any funds owed to you will be disbursed following the completion of outstanding orders.

If you wish to voluntarily terminate your account, you may do so by contacting our support team at Admin@ekshop.store. Please note that once your account is terminated, you will no longer be able to access your transaction history or account data.

6. Modifications to Terms

We may modify these Terms and Conditions at any time to reflect changes in our platform, services, or applicable laws. Any updates to the Terms will be communicated to you via email or through your Seller dashboard. You are responsible for reviewing these Terms periodically to ensure your continued compliance.

Your continued use of Ekshop after the modifications have been made constitutes your acceptance of the updated Terms and Conditions. If you do not agree with the modified terms, you must discontinue using the platform immediately and contact our support team to terminate your account.
