Terms and Conditions
for Using Ekshop
These Terms and Conditions govern the relationship between you — the Seller, Vendor, or Business — and Ekshop. By using our platform, you agree to the conditions outlined in this document. This agreement clarifies your responsibilities as a seller and our role in facilitating transactions between you and the end customer.
Platform Usage
Ekshop is an online platform designed to facilitate the sale of products between businesses and end customers. As a Seller, you will have access to a dedicated dashboard where you can manage product listings, review orders, and track sales data.
You bear full responsibility for ensuring that your listed products meet all applicable legal and regulatory requirements — including accurate descriptions, pricing, availability, and imagery. We reserve the right to remove listings that violate our policies, contain prohibited content, or fail to comply with relevant laws. Any attempt to list counterfeit goods or engage in fraudulent activity will result in immediate account termination and may result in legal action.
Commission Structure
As of the effective date, we do not charge any commission or fees on items sold through our platform. Every shilling you earn goes directly to you.
This seller-first approach is core to our mission to empower local businesses. As Ekshop grows, we plan to introduce optional paid packages offering increased product visibility, advanced analytics, and promotional opportunities — all value-driven, never a barrier.
Responsibilities of the Seller
As a Seller on Ekshop, you are responsible for:
- Maintaining accurate and up-to-date product listings, including descriptions, prices, and stock levels.
- Ensuring your products meet the quality standards expected by customers and comply with all applicable laws.
- Handling returns, exchanges, and refunds in accordance with our guidelines and within a reasonable timeframe.
- Communicating transparently with customers to resolve any disputes or complaints.
Failure to maintain accurate listings may lead to negative customer experiences and impact your standing on the platform. We encourage transparency and open communication as the foundation of long-term success.
Liability
Ekshop is a facilitator of an online marketplace. We do not take ownership of listed products, nor do we guarantee their quality, safety, or legality. As a Seller, you are solely responsible for the products you list, and any disputes or legal issues arising from their sale are your responsibility.
We provide the platform "as is" without warranties of any kind. We cannot guarantee the platform will be available error-free or without interruption. In no event shall Ekshop be liable for any indirect, incidental, or consequential damages arising from your use of the platform or the sale of products through it.
Termination
Ekshop reserves the right to terminate or suspend your account at any time for violations of these Terms, including fraudulent activity, misrepresentation, or failure to comply with platform policies. Upon termination, all pending transactions will be settled according to our usual payment schedule.
If you wish to voluntarily close your account, contact our support team at Admin@ekshop.store. Please note that once your account is closed, access to your transaction history and account data will no longer be available.
Modifications to Terms
We may modify these Terms at any time to reflect changes in our platform, services, or applicable laws. Updates will be communicated via email or through your Seller dashboard. You are responsible for reviewing these Terms periodically.
Your continued use of Ekshop after modifications have been posted constitutes your acceptance of the updated Terms. If you do not agree with the modified terms, you must discontinue using the platform and contact our support team.
Delivery Pricing Adjustments
Ekshop operates in a dynamic logistics environment where delivery costs are subject to frequent changes due to market fluctuations, fuel price volatility, courier rate adjustments, seasonal demand shifts, toll fee modifications, and regional economic factors. To ensure we can continue providing reliable and fast shipping services while maintaining platform sustainability, Ekshop reserves the right to modify delivery pricing at any given moment without prior individual notice to sellers. Such adjustments may apply to specific geographic zones, product categories, or the entire marketplace based on real‑time operational needs and prevailing market conditions.
We will make reasonable efforts to communicate significant delivery price changes through your seller dashboard, platform announcements, or periodic email summaries. However, you acknowledge that delivery fees are inherently variable and can change instantly. Our sellers are strongly advised to regularly review the latest delivery rates before setting product prices or accepting customer orders, as delivery adjustments may impact total transaction costs, margins, and customer expectations. By continuing to use Ekshop after any delivery pricing modification, you expressly agree that these adjustments are a normal, unavoidable aspect of marketplace operations and that Ekshop shall not be held liable for any loss, inconvenience, reduced profit, or customer dispute arising from such changes. This flexible approach allows us to adapt quickly to unpredictable economic realities while keeping our delivery network efficient and trustworthy.
